Terms & Conditions

These Terms and Conditions govern your access to and use of the
Building Permit Group website. They explain the nature and limits
of the general information available online and how separate
project agreements are handled.

Important distinction

These are website Terms of Use. A paid project is governed by the
written proposal, scope, fee schedule and service agreement accepted
for that project. If a project agreement conflicts with these website
terms, the project agreement governs for that project.

01 — Agreement

Acceptance of These Terms

By accessing or using this website, you agree to these Terms
and Conditions and our Privacy Policy. If you do not agree,
do not use the website.

You must use this website only for lawful purposes. If you
use the website on behalf of another person, organization or
property owner, you represent that you are authorized to do so.

02 — Business

About Building Permit Group

Building Permit Group provides residential permit drawing,
project-documentation and permit-related support services for
homeowners, property owners and authorized representatives in
Toronto, the Greater Toronto Area and surrounding Ontario
municipalities.

The words “Building Permit Group,” “we,” “us” and “our” refer
to the business operating this website. References to “you”
include website visitors, prospective clients, clients and
authorized project representatives, as applicable.

03 — General Information

Website Content Is Not Project-Specific Advice

The information on this website is provided for general
educational and informational purposes. It is not a substitute
for an assessment of a specific property, proposed scope,
existing conditions, zoning provisions, applicable law or
municipal requirements.

Website content does not constitute legal, surveying, planning,
architectural, engineering, tax, financial or construction
advice. No professional-client relationship or service
obligation is created merely because you visit the website,
submit a form or receive general information.

Requirements change and vary

Building-permit requirements can vary by municipality,
property, project type, zoning, applicable law and the
information identified during municipal review.

04 — Paid Projects

Separate Written Project Agreements

A request for information, website form submission, telephone
conversation or preliminary discussion does not by itself create
a contract for professional services.

A paid engagement begins only when the applicable written
proposal, quotation, scope of services or service agreement is
accepted in the manner specified by Building Permit Group and
any required initial payment or retainer has been received.

The project agreement will identify the agreed scope,
deliverables, assumptions, exclusions, fees, payment schedule
and other project-specific terms.

05 — Scope

Quotations, Estimates and Scope of Work

Quotations and estimates are based on the information available
when they are prepared. Unless stated otherwise, they do not
include municipal fees, application fees, permit fees, surveys,
consultant fees, engineering, testing, inspections, construction
costs or other third-party charges.

Any validity period shown in a quotation applies. If no period
is shown, the quotation may be revised or withdrawn before
acceptance where circumstances, pricing, requirements or the
proposed scope have changed.

Work not expressly included in the accepted scope is additional
work and may require written authorization, a revised fee or a
separate agreement.

06 — Your Obligations

Client and Property-Owner Responsibilities

The client and property owner are responsible for providing
timely, complete and accurate information reasonably required
for the project, including where applicable:

  • the correct property address and ownership or authorization information;
  • surveys, existing plans, reports, photographs and municipal correspondence in their possession;
  • accurate descriptions of existing conditions and proposed work;
  • safe and timely property access where a site visit or measurement is included;
  • prompt review of drawings, questions, assumptions and requested decisions;
  • notice of known easements, heritage status, orders, violations, prior work or property restrictions; and
  • authorization to share relevant information with municipalities, consultants or project participants where required.

Building Permit Group may rely on information supplied by the
client, owner, municipality and third parties unless the agreed
scope expressly requires independent verification.

07 — Authorities

Municipal Review, Permits and Other Approvals

Municipalities and other authorities independently review and
decide applications. Building Permit Group does not control
municipal staff, review comments, fees, scheduling, processing
times, interpretations, required revisions or final decisions.

We do not guarantee that a permit, variance, zoning certificate,
heritage approval, conservation approval or any other authorization
will be issued, or that it will be issued by a particular date.

A municipality or other reviewer may request additional drawings,
reports, professional information, fees, revisions or approvals
that were not reasonably identifiable at the beginning of the
project. Work required to respond may be additional to the
original scope.

No construction before required approvals

The owner and contractor are responsible for confirming that
all required permits and approvals have been issued before
regulated construction begins.

08 — Third-Party Expertise

Engineers, Surveyors and Other Consultants

Some projects require services or documents from a professional
engineer, surveyor, arborist, planner, energy adviser, geotechnical
consultant, conservation specialist or another third party.

Unless expressly included in the accepted project agreement,
third-party services and fees are not included. Where Building
Permit Group assists with coordination, the third-party provider
remains responsible for that provider’s own work, opinions,
documents, schedules and professional obligations.

09 — Financial Terms

Fees, Invoices, Taxes and Payments

Project fees, deposits or retainers, taxes, invoice dates and
payment milestones are set out in the applicable project agreement.
Payments must be made using an accepted payment method and within
the stated time.

Building Permit Group may pause work or withhold further
deliverables where an invoice is overdue, subject to the project
agreement and applicable law. The client remains responsible for
undisputed amounts earned for authorized work performed.

Municipal, authority and third-party fees are payable by the
client unless the written project agreement expressly states
otherwise.

10 — Project Changes

Revisions, Additional Work and Delays

Client-requested design changes, changes to existing conditions,
revised municipal requirements, inaccurate or incomplete source
information, new consultant requirements and review comments
outside the original scope may require additional services and fees.

Project schedules are estimates unless a written agreement
expressly states otherwise. Timing may be affected by client
decisions, site access, third-party response times, consultant
availability, municipal review, system interruptions, emergencies
and other circumstances outside our reasonable control.

We will use reasonable efforts to communicate material scope,
fee or schedule changes when they become known.

11 — Documents

Drawings, Deliverables and Intellectual Property

Website text, graphics, layouts, branding and original content
are owned by or licensed to Building Permit Group and are
protected by applicable intellectual-property laws.

Ownership and permitted use of project drawings and deliverables
are governed by the applicable project agreement. Unless that
agreement states otherwise, after payment of all amounts due,
the client receives a limited, non-exclusive licence to use the
final issued deliverables for the identified project and property.

Drawings may not be reused for another property, materially
modified by others, sold, licensed, published or represented as
suitable for a different project without written permission.
Preliminary, draft, review and superseded documents must not be
used for construction.

12 — Website Rules

Acceptable Use of the Website

You must not:

  • use the website for unlawful, fraudulent, abusive or misleading purposes;
  • attempt to gain unauthorized access to accounts, servers, databases, forms or administrative areas;
  • introduce malware, harmful code, automated attacks or excessive traffic;
  • scrape, copy or republish substantial website content without permission;
  • impersonate another person or submit information without authority;
  • interfere with website operation, security or another user’s access; or
  • use the website in a way that infringes another person’s rights.

We may restrict or block access where reasonably necessary to
protect the website, users, our business or third parties.

14 — Website Availability

Disclaimers

We make reasonable efforts to keep website information useful
and current, but we do not warrant that every page is complete,
error-free, current or suitable for a specific property or project.

The website is provided on an “as available” basis. To the
fullest extent permitted by law, we do not guarantee uninterrupted
operation, permanent availability, freedom from technical errors
or compatibility with every browser, device or system.

Photographs, renderings, diagrams, sample drawings and project
descriptions are illustrative. They do not establish the scope,
price, code compliance, approval status or expected result of
another project.

15 — Responsibility

Limits Relating to Website Use

To the fullest extent permitted by applicable law, Building
Permit Group is not responsible for losses arising solely from
reliance on general website information instead of obtaining
project-specific advice, or from third-party websites, website
interruptions, unauthorized access or events beyond our reasonable
control.

Nothing in these Terms excludes or limits liability that cannot
lawfully be excluded or limited. Liability relating to paid
services is governed by the applicable project agreement and
mandatory law.

Website use

General online information must not replace a review of
the specific property and proposed work.

Paid services

Project obligations and remedies are determined by the
accepted written agreement and applicable law.

16 — Mandatory Rights

Ontario Consumer Rights Are Not Waived

These Terms are not intended to waive, restrict or replace any
right, remedy, warranty or protection that cannot lawfully be
waived under Ontario consumer-protection or other applicable law.

If a provision of these Terms conflicts with a mandatory legal
requirement, the mandatory requirement prevails to the extent of
the conflict.

17 — Jurisdiction

Governing Law

These website Terms are governed by the laws of the Province of
Ontario and the federal laws of Canada applicable in Ontario,
without regard to conflict-of-law principles.

Subject to any mandatory consumer right to bring a proceeding
elsewhere, disputes relating to these website Terms will be
submitted to courts of competent jurisdiction in Ontario.

18 — General Provisions

Changes, Severability and Entire Terms

Changes to these Terms

We may update these Terms when website features, services,
business practices or legal requirements change. Updated Terms
will be posted on this page with a revised “Last updated” date.
Changes apply prospectively from the posted date.

Severability

If any provision is found invalid or unenforceable, it will be
limited or removed only to the extent necessary, and the remaining
provisions will continue to apply.

No waiver

A failure to enforce a provision on one occasion does not waive
the right to enforce it later.

Electronic communications

You agree that notices, proposals, approvals and other
communications may be provided electronically where permitted
by law and accepted by the parties. A project agreement may set
additional requirements for signatures, approvals and notices.

Entire website terms

These Terms and the Privacy Policy form the complete agreement
concerning use of the public website. They do not replace an
accepted project agreement.
